Amanda Bynes apparently has her father by her side. He’s defending the former child star, insisting she was not drunk on the night of her DUI.

“She was not drunk,” Rick Bynes tells People magazine. “I was told that she blew a zero on the Breathalyzer. She didn’t have a single drink that night. My daughter doesn’t drink.”

Amanda Bynes, 26, was arrested for a DUI last week in West Hollywood after side-swiping a cop car with her black BMW around 3 a.m. The accident caused no injuries and resulted in minor car damage that required paint transfer on both vehicles, cops said. As the collision investigation unraveled, cops determined that Bynes was unfit to drive. Her bail was set for $5,000, according to jail records.

Rick Bynes claims the cop who arrested his daughter was at fault for causing the accident, allegedly pulling out in front of the actress as she was turning at a West Hollywood intersection. Rick adds that Amanda was not impaired, but was arrested because “she was upset and very emotional.”

Rick went on to explain that the “All That” actress was released with no bail. “She is a good girl. She just chooses not to work, and because of that, people go after her.”

According to TMZ, hotel staff members were aware of Bynes drinking at the nightclub at The Standard  hours before her DUI arrest.

Not even a full day later, Bynes reportedly tried to frequent the same hotel bar on Sunset Boulevard, but was turned away.

Bynes will show up in court when a date is set.
