Teen Mom” trainwreck Jenelle Evans can’t stay away from the wacky tobaccy.

Now the MTV troublemaker’s penchant for pot could land her in the clink for 45 days, her lawyer says.

Evans, 19, is due in a North Carolina courtroom on August 24 to tell the judge why she tested positive last week for THC — an active ingredient in marijuana – while on probation for another drug-related charge.

“She probably won’t be taken into custody at that time,” attorney Dustin Sullivan tells HollywoodLife.com. “She will have a second court date where the judge will decide if she is guilty.”

Jenelle better hope her jury doesn’t read TMZ.

On Friday, the gossip website posted photos of the reality star posing with what appears to be her favorite herbal substance.

Jenelle – whose rap sheet includes arrests for breaking and entering, stealing credit cards, and beating the bejesus out of a friend on video – was hoping to erase a charge of possessing drug paraphernalia from last year.

“If Jenelle goes to jail, her probation will be done and the jail time will be her sentence,” Sullivan says.

Becoming a guest of the State could also cause Jenelle to lose custody – at least temporarily – of one year old son Jace.

Her mother Barbara took care of the tot while Jenelle was in rehab this spring.

According to Radar Online, the tabloid magnet “was discharged from inpatient drug treatment on [June 7] and recommended aftercare/dicharge plan was not followed. Since the defendant’s discharge from inpatient treatment she has failed to follow up with any aftercare.”

She is also reportedly $320 behind on court payments.
